KIHILL REALTY – CLIENT SERVICE & TRANSACTION POLICY

At KIHILL Realty, we are committed to delivering premium, professional, and transparent real estate brokerage services. This policy outlines our role, responsibilities, and the expectations we have of our clients to ensure smooth, ethical, and successful transactions.

1. Our Advisory Role

KIHILL Realty acts strictly as a real estate brokerage and advisory firm. Our role is to provide expert guidance, market insights, and professional recommendations to assist clients in making informed property decisions.

All advice provided is based on available information, market experience, and professional judgment at the time of engagement. Final decisions remain solely the responsibility of the client.

2. Independent Verification & Due Diligence

While KIHILL Realty makes every commercially reasonable effort to verify property details and validate information provided by property owners, developers, or third parties:

  • We do not guarantee the accuracy, completeness, or authenticity of such information.

  • Clients are strongly advised to carry out independent verification, including:

    • Title verification

    • Property condition inspection

    • Legal and financial due diligence

We can recommend trusted professionals (lawyers, surveyors, inspectors), but the responsibility for verification lies with the client.

3. Limitation of Liability for Misrepresentation

KIHILL Realty shall not be held liable for any false, misleading, or incomplete information provided by property owners, developers, or third parties.

  • Property owners are solely responsible for the accuracy of their listings.

  • Clients are encouraged to seek independent legal counsel before making any financial commitment.

4. Client Responsibility

Clients are expected to:

  • Conduct independent research and inspections

  • Review all legal documents thoroughly

  • Confirm satisfaction with the property before making payment

  • Engage professionals where necessary (legal, structural, financial)

KIHILL Realty may assist with guidance and referrals, but final responsibility rests with the client.

5. Payment & Refund Policy

KIHILL Realty operates as an intermediary between clients and property owners/developers.

  • In the case of any refund request, we will:

    • Engage the property owner/developer

    • Attempt to facilitate a fair resolution

However:

  • Refund decisions are solely at the discretion of the property owner/developer

  • KIHILL Realty does not control, guarantee, or enforce refunds

  • Clients are expected to have completed due diligence and expressed satisfaction prior to payment

6. Anti-Circumvention (Client Protection Clause)

All properties introduced to clients by KIHILL Realty remain protected under our brokerage rights.

  • Clients must not bypass KIHILL Realty to deal directly with property owners introduced by us.

  • Any attempt to circumvent our involvement after inspection or introduction will be considered a breach of agreement.

KIHILL Realty reserves the right to:

  • Pursue legal action

  • Claim full professional fees/commission

7. Professional Integrity & Engagement

We expect all clients to maintain:

  • Transparency in communication

  • Good faith throughout the transaction process

  • Respect for professional boundaries and agreements

8. General Terms

This policy serves as a general guideline governing our operations and client relationships. It may not cover all possible scenarios.
